THIS DECLARATION, made this 10th day of December, 1985 by RYAN HOMES, INC., a Pennsylvania Corporation (hereinafter called "Ryan");
WITNESSETH:
WHEREAS, the Oxxford Hunt Associates by instrument dated October 10, 1985, recorded in Book 3583, Page 15, Wake County Registry subjected certain property in Oxxford Hunt to the protective covenants therein set forth; and
WHEREAS, Ryan is the owner of the hereinafter described lot and desires to subject the same to the protective covenants recorded in Book 3583, Page 15, Wake County Registry each and all of which shall be for the benefit of such property and for each and every owner thereof, and shall inure to the benefit of and pass and run with said property and each and every lot or parcel thereof, and shall apply to and bind the successors in interest and any owner thereof.
NOW, THEREFORE, Ryan hereby declares that the real property described below is and shall be held, transferred, sold and conveyed subject to the protective covenants set forth in the Declaration recorded in Book 3583, Page 15 of the Wake County Registry, North Carolina, said protective covenants being incorporated herein by reference:
Being all of Lots 7 inclusive, according to map entitled "Oxxford Hunt - P.U.D., Ashcroft Subdivision", dated 6/20/85, prepared by Triangle Engineering Services, Inc. and recorded in Book of Maps 1985, Page 1199 Wake County Registry.
