This Waiver is entered into by and between OXXFORD HUNT ASSOCIATES, INC., A NORTH CAROLINA PARTNERSHIP, (hereinafter called Declarant) and JOHN A. SHELTON, JR. and wife YVONNE D. SHELTON, as current owners (hereinafter called Owner) of Lot 101, Section 1, Phase 1, Andover Subdivision, as recorded in Book of Maps 1985, Page 883, Wake County Registry;

WITNESSETH:

WHEREAS, Declarant has imposed upon the aforementioned lot Protective Covenants through recordings at Book 3583, Page 15, Wake County Registry, and

WHEREAS, Said Protective Covenants provide in Article IV that "no dwelling should be erected on the lot nearer to the front lot line than 35 feet..."; and

WHEREAS, the house located on the lot is situated in violation of the front setback requirements as described in the Protective Covenants, and

NOW THEREFORE, Declarant for good cause hereby waives the violation of front setback requirements as stated in the Protective Covenants on the aforementioned lot as disclosed on the survey for Casey B. Jones and wife, Susan L. Jones which is attached hereto and incorporated herein be reference. Declarant further covenants and agrees that it will not seek to enforce the setback requirements as stated in the Protective Covenants either now or in the future.
