WHEREAS, Article IV of the protective covenants for ANDOVER SECTION of OXXFORD HUNT (as same are recorded in Book 3583 at Page 15, and as amended in Book 3659 at Page 771 both in the Wake County Registry) require each dwelling to be located at least 10 feet from a side property line;

WHEREAS, the dwelling on Lot 160 of ANDOVER (as such lot is shown on a plat recorded in Book of Maps 1985, Page 875 in the WAKE County Registry) was inadvertantly constructed 9.87 feet from the side property line;

WHEREAS, Article VIII of the protective covenants permits the Declarant to waive violations of setback requirements which do not exceed 10% of the requirement;

NOW THEREFORE, for valuable consideration, receipt and sufficiency of which is hereby acknowledged, Declarant hereby waives the 10-foot side setback requirement of Article IV of the protective covenants as it applies to Lot 160 of ANDOVER Section of OXXFORD HUNT (Book of Maps 1985, Page 875), so as to permit the dwelling thereon to remain 9.87 feet from the side property line.

IN WITNESS WHEREOF, Declarant has caused this instrument to be executed as of the 14th day of June, 1990.
