  |   |   THIS DECLARATION OF APPROVAL-WAIVER, made this 10th day of November, 1989, by and between OXXFORD HUNT ASSOCIATES, a North Carolina Partnership (the "Company"), and INSITE DEVELOPMENT, INC. (the "Owner"), a North Carolina corporation; WITNESSETH: ThatWHEREAS, Company is the developer of lots shown on map of Oxxford Hunt P.U.D. Andover, Section 2, Phase 2, recorded in Book of Maps 1986, Page 521, Wake County Registry, which lots are subject to Restrictive Covenants recorded in Book 3583, Page 15, Wake County Registry and the Declaration of Covenants and Restrictions (the "Declaration") recorded in Book 3622, Page 332, Wake County Registry; AND WHEREAS, Article IV of said Restrictive Covenants provides in part that "Unless prior architectural approval is obtained.... no dwelling shall be located .... nearer to the side line than 10 feet; and WHEREAS, Owner is the owner of Lot 17 of Oxxford Hunt P.U.D. Andover Section 2, Phase 2 recorded in Book of Maps 1986, Page 521, Wake County Registry and has requested that Company, pursuant to Article VII, Section 2 of the Declaration, approve the location of a dwelling thereon as shown on Exhibit "A" attached hereto; and AND WHEREAS, Company has agreed to approve such location. NOW THEREFORE, in consideration of the premises and the covenants herein contained, Company hereby agrees with Owner and all subsequent owners of Lot 17 that the location of the dwelling thereon as shown on Exhibit "A" is hereby approved. IN WITNESS WHEREOF, OXXFORD HUNT ASSOCIATES has caused this instrument to be executed as of the day and year first above written.   |
