WITNESSETH:

WHEREAS, Central Builders, Inc. of Mebane, a North Carolina Corporation, is the owner of certain real property described as "Lot 23 Andover" according to map entitled "Oxxford Hunt - P.U.D., Andover Subdivision, Cary Township, Wake County, North Carolina, dated 2-13-86, revised 3-4-86, Prepared by Triangle Engineering Services, Inc. and recorded in Book of Maps 1986, Page 521, Wake County Registry", said property having been conveyed to Central Builders Inc. of Mebane by deed recorded in Book 4265, Page 128, Wake County Registry; and

WHEREAS, P.M. Homes, Inc., a North Carolina Corporation, has caused a residence to be constructed upon said Lot 23 Andover and the wood deck at the rear of said residence encroaches into the "25 foot Conservation Easement" which is depicted upon the aforedescribed map recorded in Book of Maps 1986, Page 521, Wake County Registry; and

WHEREAS, the aforedescribed Lot 23 Andover, together with residence constructed thereon is to be sold to Joseph P. Zublena and wife, Lisette S. Zublena; and

WHEREAS, Central Builders, Inc. of Mebane and P.M. Homes, Inc. have requested that the Town of Cary waive the aforedescribed encroachment as the same is depicted on the attached survey by Irwin A. Staton, dated 5-12-88, Revised 6-20-88 which is incorporated herein by reference; and

WHEREAS, the Town of Cary has agreed to waive the aforedescribed encroachment.

NOW THEREFORE, THE TOWN OF CARY hereby waives the encroachment of the wood deck at the rear of the residence located on Lot 23 Andover into the 25 foot Conservation Easement as said encroachment is depicted on the attached survey by Irvin A. Staton, Registered Land Surveyor and hereby agrees that the wood deck as depicted on said survey shall not be deemed to be in violation of any ordinance of the Town of Cary and may remain in its present location.
