  |   |   THIS DECLARATION OF WAIVER, made this 7th day of January, 1987, by and between Oxxford Hunt Associates, a North Carolina Partnership and Howard Bell Maddry, Jr. and wife, Karen H. Maddry, their heirs, successors and assigns; WITNESSETH: ThatWHEREAS, Oxxford Hunt Associates is the developer of lots shown on map entitled "Oxxford Hunt - P.U.D., Andover Subdivision, Cary Township, Wake County, North Carolina, Phase II, Section One", and recorded in Book of Maps 1986, Page 709, Wake County Registry, which lots are subject to restrictive covenants recorded in Book 3583, Page 15, Wake County Registry; and WHEREAS, Paragraph 4 of said restrictive covenants provide in part that "no dwelling shall be erected on any lot nearer . . . side line than 10 feet"; and WHEREAS, Declarant reserved the right to waive any minor violations of the setback requirements set forth in said restrictive covenants; and WHEREAS, Howard Bell Maddry, Jr. and wife Karen H. Maddry are the owners of Lot 55, Phase II Section 1 Andover Subdivision recorded in Book of Maps 1986, Page 709, Wake County Registry, on which lot has been constructed a dwelling with a brick porch and said brick porch is located 7.4 feet from the side lot line; and WHEREAS, declarant has agreed to waive any possible violation of said restrictive covenants. NOW THEREFORE, in consideration of the premises and the covenants herein contained, Declarant hereby agrees with Howard Bell Maddry and wife, Karen H. Maddry and all subsequent owners of Lot 55 that the above referred to violation is hereby waived, and that the dwelling and brick porch located on said lot may remain in its present location. IN TESTIMONY WHEREOF, OXXFORD HUNT ASSOCIATES has caused this instrument to be signed in its partnership name by its Partners, the day and year first above written.   |
