  |   |   THIS WAIVER, given this day by Oxxford Hunt Associates, Declarant under Declaration recorded in Book 3583 at Page 15, Wake County Registry for Andover Section of Oxxford Hunt, and as amended in Book 3659 at page 771, Wake County Registry (jointly referred to herein as "Declaration") to Eddy L. Hanah and wife, Mary Virginia Hannah, 105 Leckford Way, Cary, NC 27511; WITNESSETHTHAT WHEREAS, said Declaration provides that "...no dwelling shall be erected on any lot nearer to the ..side line than 10 feet.."; and THAT WHEREAS, said Declaration further provides that "Declarant reserves the right to waive violations not in excess of 10% of the front and side street and side line setback requirements. Upon the execution and recordation of such waiver or waivers in the Wake County Registry, such violations shall not thereafter be deemed existing.";and THAT WHEREAS, Eddy L. Hannah and wife, Mary Virginia Hannah own certain property located in Andover Subdivision which is subject to Declaration, more particularly described as follows: Lot 63, Phase II, Andover Hunt Subdivision, Oxford Hunt-PUD, as per plat prepared by Triangle Engineering Services, Inc., dated 2/13/86 and now on file in the Office of the Register of Deeds of Wake County in Book of Maps 1986 at page 709, to which map reference is hereby made for a more particular description of same. THAT WHEREAS, the property is setback 9.68 feet from the northern side property line, which deviates less than 10% from the required setback in the Declaration; and THAT WHEREAS, Declarant desires to waive said violation. NOW THEREFORE, Declarant hereby agrees and sets forth that the setback of 9.68 feet from the side property line for that property hereinabove described shall not be deemed a violation of the Declaration. IN WITNESS WHEREOF, Declarant has caused this instrument to be executed this 30th day of June, 1992.   |
