  |   |   This Declaration of Withdrawal, made this 4th day of December, 1986, by Oxxford Hunt Associates, a North Carolina partnership, (hereinafter called "Company") and the undersigned owners (the "Property Owners"). WITNESSETH: thatWHEREAS, the Company is the developer of Oxxford Hunt P.U.D. (the "P.U.D."), and in this connection subjected certain properties (including the tracts described in Exhibit A attached hereto) to a Delaration of Covenants and Restrictions (the "Master Covenants") recorded in Book 3622, Page 332, Wake County Registry; and WHEREAS, pursuant to Article II, Section 1 of the Master Covenants, Company has revised the master plan of the P.U.D., the result of which is to remove the tracts described on Exhibit A therefrom; and WHEREAS, the Property Owners have requested, and the parties hereto desire that the tracts described on Exhibit A be withdrawn from the operation of the Master Covenants. NOW, THEREFORE, in consideration of the foregoing the parties hereto hereby withdraw the tracts described in Exhibit A from the operation of the Master Covenants recorded in Book 3622, Page 332, Wake County Registry. IN WITNESS WHEREOF, the parties hereto have caused this Declaration to be executed as of the day and year first above written. EXHIBIT "A"Tract 1 (T.R. Smith, Inc.) Beginning at a point lying in the middle of the right-of-way of Old Apex Road (N.C.S.R. 1616), said point being South 13 degrees 21 minutes 01 second West 359.50 feet, South 13 degrees 59 minutes 56 seconds West 362.21 feet, South 15 degrees 16 minutes 49 seconds West 258.01 feet and South 89 degrees 56 minutes 10 seconds East 48.60 feet from a point bearing North Carolina Grid Coordinates Y=736,849.6930, X=2,057,347.7916; runs thence South 89 degrees 56 minutes 10 seconds East 564.29 feet to a point lying in the middle of the right-of-way of Seaboard Coast Line; runs thence South 23 degrees 12 minutes 28 seconds West 306.90 feet to a point lying in the eastern right-of-way of West Chatham Street; runs thence along the eastern right-of-way of West Chatham Street the following courses and distances:
Tract 2 (Town of Cary) Being all of Lot 3, containing 3.00 acres according to map entitled "Oxxford Hunt, Cary Township, Wake County, North Carolina, Road Relocation for SR 1011 and SR 1616, Section B: Lots 1-3", dated 9/24/84, revised 10/3/84, 1/2/85, 4/24/85 and 5/30/85, prepared by Triangle Engineering Services, Inc., and recorded in Book of Maps 1985, Page 1039 Wake County Registry.   |
