  |   |   THIS DECLARATION OF WAIVER, made this the 13th day of October, 1988, by and between Oxxford Hunt Associates, a North Carolina Partnership (hereinafter referred to as Seller) and M/I SCHOTTENSTEIN HOMES, INC. (hereinafter referred to as Purchaser); WHEREAS, Purchaser desires to buy from Seller and Seller desires to sell to Purchaser all of Lot 15 of Swallow Hill Subdivision, as same is shown on a map thereof recorded in Map Book 1987 at Page 1784 of the WAKE County Registry. WHEREAS, Purchaser intends to build a house on this corner lot for which one corner is 17.44 feet from the street as is shown in the plans which were submitted to Oxxford Hunt Associates; WHEREAS, the Declaration of Protective Covenants for Swallow Hill Subdivision recorded at Book 4040 at Page 268 and as amended at Book 4131 at Page 6, both of the WAKE County Registry, has a side setback requirement for houses on corner lots of no greater than 20 feet. WHEREAS, ARTICLE VII, Section 2 of the Declaration of Covenants and Restrictions of Oxxford Hunt Community Association and Oxxford Hunt Associates, a North Carolina Partnership authorizes Oxxford Hunt Associates to approve the location of a house constructed on a lot in Oxxford Hunt Planned Unit Development in its sole and uncontrolled discretion. NOW, THEREFORE, for valuable consideration, receipt and sufficiency of which is hereby acknowledged, Oxxford Hunt Associates hereby approves the location of the house to be constructed by Purchaser on Lot 15 of Swallow Hill Subdivision and waives the violation of the setback requirement of Article IV of the protective covenants as it applies to Lot 15 of SWALLOW HILL Section of Oxxford Hunt, and hereby executes this document to reduce this pre-authorization to writing. IN WITNESS WHEREOF, Seller has caused this instrument to be executed as of the day and year first above written.   |
