  |   |   THIS FRONT SETBACK REQUIREMENT COMPLIANCE CERTIFICATION is made this 27th day of March, 1990, by Viking Homes, Inc., a North Carolina Corporation, (hereinafter referred to as "Declarant") and William H. Boyette and Marian L. Boyette, (hereinafter referred to as "Buyers"). WITNESSETHWHEREAS, The Declarant as the owner of Lot 31, Section 2 of Thamesford Subdivision as recorded in Book of Maps 1989, page 827, Wake County Registry, has sold the same to the Buyers; and WHEREAS, said property is subject to certain Declarations of Covenants as recorded in Book 4636, page 439, Wake County Registry, of which Declarant was also the Declarant thereof; (hereinafter referred to as "Declaration"); and WHEREAS, Article IV of the Declarations provides that "Unless prior architectural approval is obtained pursuant to Article XII hereof, no dwelling shall be erected on any lot near to the front line than 25 feet ... "; and WHEREAS, said dwelling is now located 21.0 feet from the front lot line; and WHEREAS, the Declarant obtained architectural approval of the location of the dwelling on the Lot prior to construction of said dwelling in accordance with Article XII of the Declaration; and THEREFORE, the Declarant does hereby certify to the Buyers, their heirs, successors and assigns that the house on Lot 31, Section 2, Thamesford Subdivision, as recorded in Book of Maps 1989, Page 827, Wake County Registry, located 21.0 feet from the front lot line is in compliance with the Declaration, in that in accordance with Article IV of the Declaration, prior architectural approval was obtained in accordance with Article XII of the Declaration as evidenced by Exhibit A and B attached hereto showing that prior approval was properly obtained to allow the dwelling to be located no closer than 21.0 feet from the lot line, and said dwelling, which is located 21.0 feet from the front lot line is in conformity with Article IV of the Declaration as a result of the prior architectural approval. IN WITNESS WHEREOF, Viking Homes, Inc., has caused this instrument to be executed as of the day and year first above written.   |
