WAIVER OF PROTECTIVE COVENANTS

WHEREAS, Article IV of the protective covenants for TRAFALGAR Section of OXXFORD HUNT (as same are recorded in Book 3981 at Page 256 in the Wake County Registry) require each dwelling to be located at least 25 feet from its front porperty line;

WHEREAS, the dwelling on Lot 14 of TRAFALGAR (as such lot is shown on a plat recorded in Book of Maps 1987 at Page 504 in the WAKE County Registry) was inadvertantly constructed 24.79 feet from its front property line;

WHEREAS, Article VIII of the protective covenants permits the Declarant to waive violations of setback requirements which do not exceed 10% fof the requirement;

NOW, THEREFORE, for valuable consideration, receipt and sufficiency of which is hereby acknowledged, Declarant hereby waives the 25-foot front setback requirement of Article IV of the protective covenants as it applies to Lot 14 of TRAFALGAR Section of OXXFORD HUNT.
